BAR SEEN PRIVACY POLICY

BarSeen, Inc. (“BarSeen,” “we,” “us,” or “”our”) respects your privacy and has prepared this
Privacy Policy (“Policy”) to explain how we collect, use, disclose, and safeguard information when
you use the Bar Seen mobile application, barseen.com, and related features (collectively, the
“Services”). This Policy applies to information collected through the Services, through your
communications with us, and through our advertising on third-party platforms that link to this
Policy. It does not apply to information collected offline or by any third party, including
Participating Venues, except as described below.
By accessing or using the Services, you agree to this Policy. If you do not agree, please do not use
the Services. We may update this Policy from time to time; material changes will be reflected in
an updated “Last Updated” date and, where required by law, additional notice.
1. Age Restrictions
The Services are intended for use only by individuals twenty-one (21) years of age or older,
consistent with their focus on bars, restaurants, and alcohol-serving venues. We do not knowingly
collect personal information from anyone under the age of eighteen, and we do not knowingly
permit account registration by anyone under twenty-one. If we learn that we have collected
personal information from someone under eighteen, or that an account holder is under twenty-one,
we will take steps to delete the relevant account and information. If you believe a minor has
provided us with personal information, please contact us using the details in Section 15.
2. Information We Collect
We collect the following categories of information:.
2.1 Information You Provide Directly
a. Account and contact information, such as your name, email address, phone number, and
date of birth (used to confirm you meet the 21+ age requirement);
b. Profile information, such as a photo, username, and preferences;
c. Payment and Wallet information in connection with the in-app Wallet and “Send a Drink”
feature, as described in Section 5;
d. Content you submit, such as check-ins, favorites, messages, photos, or reviews; and
e. Information you provide when you contact customer support.
2.2 Information Collected Automatically
a. Device and log information, such as IP address, device identifiers, browser type, operating
system, mobile carrier, and date/time stamps;
b. Usage information, such as which Participating Venues, camera feeds, and features you
view or interact with;

c. Location and proximity information, as described in Section 4; and
d. Cookies and similar tracking technologies, as described in Section 6.
2.3 Information From Participating Venue Camera Feeds
As described in our Terms and Conditions, Participating Venues operate their own live camera
feeds of their general interior common areas, which are displayed within the Services so users can
view real-time venue activity. These feeds do not include audio. Each Participating Venue, not
BarSeen, is the operator of its camera feed and is responsible for compliance with applicable
recording and notice laws. BarSeen does not apply facial recognition or other biometric
identification technology to camera feed content, and does not use camera feed content to identify
specific individuals. If you are physically present at a Participating Venue, your image may appear
in that venue’s live feed while you are on the premises, regardless of whether you use the Services.
2.4 Information From Third-Party Sources
If you choose to connect a third-party account (such as a social media account or your Google
account for YouTube-based features described in Section 7) to the Services, we may receive
information from that account consistent with your settings on that third-party service and this
Policy.
3. YouTube API Services
The Services use YouTube API Services to display certain live-music, event, or venue video
content. By using this portion of the Services, you agree to be bound by the YouTube Terms of
Service (available at https://www.youtube.com/t/terms). Google’s use of information collected
through the YouTube API is governed by the Google Privacy Policy (available at
https://policies.google.com/privacy.
If you have granted the Services access to your Google account (for example, to enable a YouTube-
related feature), you may revoke that access at any time through Google’s security settings page
at:
https://security.google.com/settings/security/permissions
Revoking access will not affect information already collected prior to revocation but will prevent
further access by the Services to the applicable Google account data.
4. Location and Proximity Data
We collect precise or approximate location data from your device (through GPS, Wi-Fi, Bluetooth,
or IP address) when you enable location services, in order to:
a. Show you nearby Participating Venues, camera feeds, crowd levels, drink specials, and
live music;

b. Support proximity-based social features, including showing which users are checked in
near you (unless you have enabled a visibility-limiting setting, sometimes referred to in the
application as “Ghost” mode); and
c. Enable the location-based aspects of the “Send a Drink” feature, such as identifying which
Participating Venue a drink credit is being sent to.
You can disable location services at any time through your device settings; doing so will limit your
ability to use location-dependent features of the Services, including the ability to see or be seen by
nearby users.
5. In-App Wallet and “Send a Drink” Payment Data
When you load funds into the in-app Wallet or send or redeem a drink credit, we and our third-
party payment processor, [PAYMENT PROCESSOR NAME], collect payment information such
as your payment card or bank account details, billing address, transaction amount, and transaction
history. Payment card data is transmitted directly to our payment processor in accordance with
applicable payment card industry (PCI-DSS) security standards; BarSeen does not store your full
payment card number on our own servers. We retain transaction records (such as amounts,
timestamps, and the Participating Venue involved) as needed to operate the Wallet, respond to
disputes, prevent fraud, and comply with applicable financial recordkeeping and tax laws.
6. Cookies and Tracking Technologies
We and our service providers use cookies, SDKs, and similar tracking technologies to operate the
Services, remember your preferences, measure performance, and, where applicable, provide
targeted advertising. You may control cookies through your browser or device settings, though
disabling cookies may limit certain features of the Services.
7. How We Use Your Information
We use the information we collect to:
a. Operate, maintain, and improve the Services, including the camera feed, crowd-level, drink
specials, live music, and Wallet features;
b. Verify your eligibility to use age-restricted features of the Services;
c. Process Wallet transactions and drink credit redemptions;
d. Provide customer support and respond to your requests;
e. Personalize your experience, including recommending Participating Venues;
f. Detect, investigate, and prevent fraud, abuse, and violations of our Terms;
g. Send you service, transactional, and (where you have not opted out) marketing
communications; and
h. Comply with applicable law, including responding to law enforcement or regulatory
requests.

8. How We Share Your Information
We do not sell your personal information. We may share information as follows:
a. With service providers and business partners who perform services on our behalf, such as
our payment processor, cloud hosting providers, analytics providers, and customer support
tools;
b. With Participating Venues, limited to the information reasonably necessary to facilitate
redemption of a drink credit (such as confirmation that a valid credit has been sent to that
venue), Participating Venues do not receive your full payment card information from us;
c. With Google, to the extent necessary to operate YouTube API Services features you choose
to use;
d. In connection with a merger, acquisition, financing, or sale of some or all of BarSeen’s
assets;
e. To comply with legal process, protect our rights, or protect the safety of our users or the
public; and
f. With your consent or at your direction.
9. Data Retention
We retain personal information for as long as reasonably necessary to provide the Services, comply
with our legal and regulatory obligations (including tax and financial recordkeeping related to the
Wallet), resolve disputes, and enforce our agreements. Participating Venue camera feeds are
transmitted live through the Services; BarSeen does not create a permanent, searchable archive of
camera feed footage for user access unless separately disclosed to you. Retained account and
transaction data is deleted or de-identified when no longer needed for these purposes, consistent
with applicable law.
10. Your Choices and Rights
Depending on your location, you may have the right to access, correct, delete, or receive a copy of
the personal information we hold about you, and to opt out of certain uses (such as targeted
advertising or sale/sharing of personal information, to the extent applicable). You can exercise
these rights, opt out of marketing communications, or adjust location and visibility settings
(including “Ghost” mode) through the Services or by contacting us at privacy@barseen.com. We
will respond consistent with applicable law and subject to identity verification.
11. California Residents
This section supplements the rest of this Policy for California residents under the California
Consumer Privacy Act, as amended (“CCPA”). California residents may request access to, deletion
of, or correction of their personal information, and may opt out of the sale or sharing of personal
information (to the extent applicable). We will not discriminate against you for exercising these

12. Other State Privacy Rights
Residents of states with comprehensive privacy laws in effect (including, as applicable, Colorado,
Connecticut, Virginia, Utah, Texas, and other states) may have rights to confirm whether we
process their personal information, access and delete certain personal information, obtain a
portable copy of their data, correct inaccuracies, and opt out of profiling or targeted advertising,
subject to each law’s specific terms. To exercise these rights or appeal a decision on a rights

13. Data Security
We use administrative, technical, and physical safeguards designed to protect the information we
collect. However, no method of transmission or storage is completely secure, and we cannot
guarantee absolute security. You are responsible for safeguarding your account password and
should notify us immediately of any unauthorized use of your account.
14. Third-Party Links
The Services may contain links to third-party websites or services, including Participating Venue
websites, social media pages, and ride-share services. This Policy does not apply to those third
parties, and we encourage you to review their privacy notices before providing them with
information.

16. Changes to This Policy
